Accounts

Use of Services

We reserve the right to suspend or terminate accounts engaged in misuse.
Subscription, Fees, and Payment
- Certain features may require a paid subscription. Prices and payment terms are disclosed at the time of purchase.
- You authorize us (or our third-party processor) to charge your payment method on a recurring basis.
- Fees are non-refundable except as required by law or otherwise stated in writing.
- We may change pricing with prior notice.
Intellectual Property
- All rights, title, and interest in the Services, including software, trademarks, and content, remain with AmeriTrust Auto LLC and its licensors.
- You are granted a limited, non-exclusive, non-transferable license to use the Services during your subscription.
Data and Privacy
- Our Privacy Policy explains how we collect, use, and protect your information.
- You retain ownership of your data. By using the Services, you grant us a license to host, process, and transmit your data as necessary to provide the Services.
Service Availability
- We strive to provide reliable Services but do not guarantee uninterrupted or error-free access.
- We may modify, suspend, or discontinue the Services (with or without notice) where necessary.
Third-Party Services
The Services may integrate with third-party services. We are not responsible for the content, functionality, or policies of such third parties.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, AmeriTrust Auto LLC and its affiliates are not liable for indirect, incidental, consequential, or punitive damages, or loss of profits, data, or goodwill. Our total liability for any claim will not exceed the amount you paid us in the twelve (12) months prior to the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless AmeriTrust Auto LLC, its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Services or violation of these Terms.
Termination
We may suspend or terminate your account and access to the Services if you violate these Terms. Upon termination, your right to use the Services will immediately cease.
Governing Law and Dispute Resolution
These Terms are governed by the laws of Texas, without regard to conflict-of-law principles. Disputes shall be resolved exclusively in the courts located in Dallas, unless otherwise required by applicable law.
ACH Information
I (we) hereby authorize AmeriTrust, herein called COMPANY, to initiate electronic credit entries to my dealership’s bank account indicated below at the depository financial institution named below, hereinafter called DEPOSITORY, for the purpose of purchasing Retail Installment Sales Contracts or Lease Agreements and, if necessary, to initiate adjustments for any transactions credited in error. I acknowledge that the origination of transactions to my account must comply with the provisions of U.S. law and (NACHA) rules. This authorization is to remain in full force and effect until COMPANY has received written notification from me (or other authorized dealership representative) of termination in such time and in such manner as to afford COMPANY and DEPOSITORY a reasonable opportunity to act on it.
Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email or through the Services. Continued use after changes become effective constitutes acceptance.
